Outsourcing service for foreign trade clearance of imported or exported goods

This service is optional in relation to the main service of customs clearance and represents the maximum level of service in the doing of foreign economic activity. When providing this service, we fully undertake all actions necessary for the customs clearance of the client’s goods.

So, when importing goods that must be provided to a client on DDP terms, a seller located outside the Republic of Moldova can use this option and deliver the goods to the buyer already in free circulation (after customs clearance). In this case, we will take care of all the formalities and payment of all mandatory payments.

Using this option in the export mode will also greatly facilitate the exporter’s life, since in this case we will not only file an export customs declaration for his goods, but also take over the rest of the issues related to this export: we will request and receive a certificate of origin, we will provide cargo logistics and etc.

The use of this option is also possible when declaring goods under other customs regimes. So, when placing / closing processing modes under customs control, we can take on the functions of customs accounting of processed goods and the timing of their stay in preferential mode, timely notification of expiration of terms, re-issuance of customs permits or their adjustment according to the actual situation.

Customs clearance of imports

According to Article 31 of the Customs Code, import is a customs procedure under which the goods imported to the customs territory receive the status of goods released into free circulation only after payment of import duties and application of economic policy measures.

During the customs clearance of imports, our specialists can perform the following operations, directly or indirectly required for customs clearance:

  • examination and analysis of supporting documents provided by the Client;
  • detection of inconsistencies and errors that might influence the process of customs clearance, preliminary estimation of customs duties, consultation on the possibility to obtain the exemption from paying customs duties or their optimization,
  • filling with the Customs the supporting transit documents (namely, TIR carnet or transit declaration T-1) to properly close the transit prior to import,
  • making out the customs declaration based on documents submitted by the Client, under the principle of direct or indirect customs representation,
  • preliminary physical inspection of goods subject to import in order to clarify certain data concerning the goods so as to prevent inaccurate declaration and application of penalties by the Customs authorities,
  • provision of a payment guarantee for customs duties in the event that they are not paid at customs clearance, but later. In this case, the law provides for the provision of a financial guarantee in the appropriate amount,
  • customs representation during the whole process of customs clearance, including operational consultation of the Client on current issues, explanation of rights and obligations, reissuance of necessary documents, representation in case of changes in customs documents or their cancellation.
Customs clearance of exports

According to Article 38 of the Customs Code, export is a customs regime under which goods are exported outside the customs territory without obligation to return them to this territory. During export procedure, our specialists can perform the following operations, directly or indirectly required for customs clearance:

  • examination and analysis of the supporting documents provided by the Client,
  • detection of inconsistencies and errors that might influence the process of customs clearance,
  • determination of the customs tariff code for exported goods,
  • making out the customs declaration on the basis of documents provided by the Client, on the principles of direct or indirect customs representation,
  • making out additional documents necessary for customs clearance, such as: environmental declaration, CMR note, TIR carnet,
  • preliminary physical inspection of goods subject to export in order to clarify certain data concerning the goods so as to prevent inaccurate declaration and application of penalties by the Customs authorities,
  • customs representation during the whole process of customs clearance, including operational consultation of the Client on current issues, explanation of rights and obligations, reissuance of necessary documents, representation in case of changes in customs documents or their cancellation.
Customs transit clearance

According to Article 42 of the Customs Code, transit is a customs procedure under which goods are transported through the customs territory under the customs supervision of one customs authority to another without payment of customs duties and without application of economic policy measures, unless otherwise provided by law. During the customs transit clearance, our specialists can perform the following operations, directly or indirectly required for customs clearance:

  • examination and analysis of supporting documents provided by the Client,
  • detection of inconsistencies and errors that may affect the customs clearance process, assistance in making out the missing documents or filling out accompanying documents (for example, filling out the CMR),
  • making out the customs transit declaration on the basis of documents provided by the Client, together with all accompanying documents,
  • assuming the primary responsibility for transit.
Customs clearance under preferential treatment

The customs legislation of the Republic of Moldova provides for different types of preferential treatments: temporary importation, inward processing, processing under customs control, outward processing, etc.

According to Article 67 of the Customs Code, under temporary importation procedure, foreign goods and vehicle intended for re-exportation in unchanged state can be used on the territory of the Republic of Moldova with conditional, partial or full exemption from import duties and economic policy measures, without taking into account their natural deterioration.

According to article 57 of the Customs Code, the inward processing procedure allows the use on the territory of the Republic of Moldova under one or several processing operations:

a) foreign goods intended for export from the customs territory in the form of processed products, without payment of import duties, except for the fee for customs procedures, and without application of economic policy measures, unless otherwise provided by law;

b) goods imported and released into free circulation, provided that they are exported from the customs territory in the form of processed goods. In this case, the inward processing procedure shall be carried out with payment of import payments and their refund at export.

During the customs clearance under the preferential treatments referred above, our specialists can perform the following operations, directly or indirectly required for customs clearance:

  • identification of inconsistencies and errors that may affect the process of customs clearance,
  • consultation on the possibility of obtaining permits for the use of preferential treatment,
  • filling in (including, electronically, in ASYCUDA World system) the application for a permit to use preferential treatment and customs representation of the Client’s interests in the process of considering this application.
  • making out the customs declaration on the basis of documents provided by the Client, on the principles of direct or indirect customs representation.
  • guaranteeing payment of customs duties for goods temporarily imported into the territory of the Republic of Moldova when law provides for the provision of a financial guarantee in the appropriate amount,
  • customs representation during the whole process of customs clearance, including operational consultation of the Client on current issues, explanation of rights and obligations, reissuance of necessary documents, representation in case of changes in customs documents or their cancellation.
Customs warehousing

According to Article 50 of the Customs Code, the customs warehousing allows the storage of:

a) foreign goods without payment of import duties and without applying economic policy measures;

b) domestic goods intended for export.

Our specialists can carry out customs clearance of goods placed either in our own customs warehouse or other customs warehouses. During customs clearance under this procedure, our specialists can perform the following operations, directly or indirectly required for customs clearance:

  • preliminary physical inspection of goods placed in the customs warehouse in order to clarify certain data concerning the goods so as to prevent inaccurate declaration and application of penalties by the Customs authorities,
  • guaranteeing payment of customs payments for the goods placed into the customs warehouse in case when the Client requests a financial guarantee in the appropriate amount.
  • customs representation during the whole process of customs clearance, including operational consultation of the Client on current issues, clarification of rights and obligations, reissuance of necessary documents, representation in case of changes in customs documents or their cancellation.
Assistance in obtaining permit documents

Customs guarantees

The purpose of the financial guarantee is to secure the payment of customs duties in the following cases:

  • guaranteeing collection of customs duties for foreign goods transported under the customs transit procedure (except for transports under the cover of the TIR Carnet),
  • guaranteeing collection of customs duties for foreign goods placed under customs preferential treatment, such as temporary importation, customs warehousing, etc.
  • goods, conditionally released for free circulation based on accepted customs value,
  • importation of goods with deferred payment of customs duty and VAT for the period of production cycle, but not more than 180 days, for imported raw materials, supplies, primary packaging and component parts,
  • placement of foreign goods in a temporary storage warehouse.

Since the issuing of a financial guarantee implies certain risks, a commission fee is charged, which amount is calculated depending on the type of security, period and amount of the guarantee. The lump-sum commission is usually charged to the Client, on the day the guarantee is issued. A commission might be envisaged for long-term guarantees, which is charged periodically.

When issuing a financial guarantee, in addition to flexible pricing and a system of individual discounts, our company provides an additional bonus — the Client will not have to provide a collateral for this guarantee (as for example — a pledge, guarantee deposit, surety, etc.) by the Customer.
